When President Barack Obama terminated the Yucca Mountain deep geological nuclear waste repository project, he broke the law. When Congress failed to hold the President accountable for violating the Nuclear Waste Policy Act (NWPA), three private citizens from Richland, Washington, businessmen involved in managing nuclear waste at the Hanford Site, filed suit against President Obama, the Department of Energy (DOE), and the Nuclear Regulatory Commission (NRC). Two states, two counties, and another organization affected by the termination of the Yucca Mountain Project joined Robert L. Ferguson, Bill Lampson, and Gary Petersen in their lawsuit. The U.S. Court of Appeals for the District of Columbia Circuit found that neither the President or these two federal agencies had the legal authority to terminate the Yucca Mountain Project or to stop the NRC's review of the Yucca Mountain license application. Only Congress has that authority through legislation.

On August 13, 2013, the D.C. Court of Appeals issued its final ruling--ordering the NRC to obey the law and resume its review of the Yucca Mountain license application. The private citizens won their case--holding the President and his administration accountable to the law!
